Hidalgo County, TX -- December 24, 2020, a 27-year-old woman and a 1-year-old child were injured in a single-vehicle crash on Farm to Market 1423 in Hidalgo County.

Authorities say the incident happened around 4:25 p.m. on FM 1423 near Trenton Road. Preliminary reports indicate that a Ford Mustang was headed south on the roadway when the driver lost control. The Mustang left the roadway and the driver allegedly took faulty evasive action, causing the car to enter a side skid. The car crashed twice through a fence on private property, once on the way in and another time on the way out. During the second crash with the fence the Mustang overturned and rolled several times before landing upright on the roadway.

An adult passenger in the vehicle suffered serious injuries, while a young child in the car received minor injuries. Both were taken to an area hospital for treatment.

Reports say the driver of the Mustang fled the scene on foot but was later caught and brought back to the scene. He alleged another vehicle of unknown make and model cut him off and forced him to swerve, causing the crash. Further investigation revealed the driver to be intoxicated with a tested BAC of .128. He received several charges including DWI and Failure to Stop and Render Aid - Injury.

When a driver flees a single-vehicle crash like this one, I'm often a little baffled. With witnesses left behind and the vehicle in police hands, why try to evade authorities?

That question could be answered several ways, but most often investigators find in any variation of hit-and-run crashes that a runaway wanted to hide something. Sometimes that might be outstanding warrants or some kind of illegal contraband in the car, but many times the driver is intoxicated and doesn't want police to find out. This wreck doesn't seem too different, as investigators determined the driver was intoxicated once they found him.

Since intoxication appears to be a factor in this wreck, investigators should also make it a point to find out where the driver's alcohol came from. But why does that matter?

Not everyone knows about an area of Texas law that may help victims and their families after a DWI crash. Specifically, dram shop law says that an alcohol provider who over-serves an obviously intoxicated person may be liable for damages resulting from that intoxication. If someone causes an accident on their way home from a bar, for example, that bar could bear responsibility for the crash. Not every DWI crash involves a dram shop violation and I'm not pointing accusatory fingers at any specific business in Hidalgo County, but many times it's found that a rule-breaking bar or restaurant poured the drinks that led to crashes like this one.

Hopefully with the driver apprehended, investigators can get some answers about his whereabouts before the wreck that day. Should it turn out the driver had an unseen 'accomplice' in the form of a bar or other alcohol vendor, for the victims' sake that establishment should also be held responsible for its role in their injuries.
